Terms and Conditions

1. Agreement to Terms

Welcome to Scrimmage Games (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile application (the “App”) and any services provided therein.

By creating an account or by accessing or using our App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the App.

THIS IS A TOOL FOR COACHES AND TEAM REPRESENTATIVES. YOU MUST BE 18 YEARS OF AGE OR OLDER TO USE THIS SERVICE.

2. User Accounts

Account Creation: To use the App, you must register for an account. You agree to provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

Account Security: You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

One Account Per User: You may not create more than one account for yourself as a coach or team representative.

3. Acceptable Use and Code of Conduct

The Scrimmage Games App is a professional tool for scheduling games. You agree you will not use the App to:

Post any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person, entity, or team.

Post or transmit any unsolicited advertising, promotional materials, or any other form of solicitation (spam).

Violate any applicable local, state, national, or international law.

Engage in any unsportsmanlike conduct, including harassing other coaches or using the chat feature for anything other than the good-faith scheduling of games.

The purpose of this App is to connect teams for scrimmages. It is not a platform for resolving on-field disputes, protesting game outcomes, or recruiting players from other teams.

4. User Content

You retain ownership of any content you submit through the App, including your team profile information and messages (“User Content”). However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, display, and distribute such content in connection with operating and providing the App.

You are solely responsible for your User Content and you expressly agree to exonerate us from any and all liability and to refrain from bringing any claim against us regarding your User Content.

5. Our Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Scrimmage Games and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may do so by contacting us or through the account settings within the App.

7. Disclaimer of Warranties and Limitation of Liability

The App is provided on an “AS IS” and “AS AVAILABLE” basis.

Scrimmage Games is a neutral platform for scheduling. We are not involved in the games themselves. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any personal injury, property damage, or other disputes that may arise between teams, coaches, players, or spectators as a result of a game scheduled through the App.

IN NO EVENT SHALL SCRIMMAGE GAMES, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE APP.

8. Indemnification

You agree to defend, indemnify and hold harmless Scrimmage Games and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; or b) a breach of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
